Your Excellency's Govern- ment haye set a noble example to all future times in rigidly abstaining from all acts of power, which were not justified by the result of independent, fair and impartial in- vestigation. Even after a special Commission consisting of Natives and Europeans had established the charge of misrule against His Highness Malharraw, your Ex- cellency's Government allowed him time to retrace his steps, and permitted him to. employ his own men and when the British Resident at his Court intermeddled in matters beyond legitimate limit of his office, Your Excelleney's Government removed him from his high position. This large-minded forbearance has had & most reassur- ing effect in all quarters. 5. Your Memorialists are glad to perceive that this policy of forbearance and loyal adherence to the promises of the Queen's Proclamation was not departed from even when your Excellency in Council for high reasons of State determined that Malharraw should be arrested and put on his trial, and when your Excellency's Go- vernment assumed the temporary management of his State pending the investition of the charge brought against him. Your Excellency's Government have pledge your word that whatever may become of Malharraw, the Baroda Raj will not be annexed, and that a native administration will be set up as soon as the trial is over. This re- solution of Your Excellency's Government not to punish a whole nation for the sins of its chief, is consonant with the dictates of the highest justice and mercy and far- seeing policy. 6. It is consonant with justice that the integrity of a Natire State in alliance with the British government is not bound up with the personal good behavior of the ruler for the time being of that State. The State survives a succession of rulers that live and die. So long as the subjects of a NativeState are not guilty of hostility towards the British Government it will not be just to punish them for the errors or vices of their chiefs for the time being. The State ( Dowlat ) does not belong of private right to the chief; he and the Rajamadal ( the men whose ancestors fought and bled with the aneestors of the chief, and independent civil and military population) is alike interested in it. Again the late Resident's conduct towards Durbar was such that gradually some misunderstanding arose between him and the Durbar. The misun- derstanding was aggravated into a sort of personal quarrel by the Resident's direct in- terferenco with the affairs of the Baroda State, on all occasions when his interference was not called for. Opposition to the high-handed advice or rather orders of Colonel Phayer cannot be construed into an act of hostility to the British rule in as much as the people and prince of Baroda certainly never intended to throw off allegiance to
