( ८९ ) असेः–कमिशनानीं क्षुल्लक अथवा त्रासदायक फिर्यादींस उत्तेजन देऊं नये, आणि त्याणी चौकशी केवळ अशा धोरणाने चालवूं नये कीं, जसे काय ते फिर्यादींस न्याय देण्याकरितां बसले आहेत. ब्रिटिश सरकारानी मध्यस्ती करावी अशी बडोद्याच्या राज्यांत अव्यवस्था झाली आहे की काय हें ज्यांजवरून कळेल अशा फिर्यादींची मात्र त्याणी चौकशी करावी. * ह्या नियमांविषयीं मुंबई सरकारानी + ता० २८ आक्टोवर सन १८७३ च्या पत्रांत तक्रार घेतली. त्यांचे म्हणणे असे होते की, जर फिर्यादी लोकांस असे सांगण्यांत येईल की, दाद मिळण्यासाठी तुम्हास दरबारावर अवलंबून राहिले पाहिजे, तर ते लोक कमिशनापुढे फिर्यादी करून आपल्यास संकटांत पाडून घेणार नाहींत, आणि त्यांचा परिणाम असा होईल की, कमिशनास पुरावा न मिळाल्यामुळे हल्लीं जी अव्यवस्था चालत आहे ती कायमची होईल; यासाठी व्हाइसराय साहेब यागी कमिशनास असा अधिकार द्यावा कीं, त्यांजपुढे जो कोणी फिर्यादी करील त्या प्रत्येकास त्याणी असे अश्वासन द्यावें
- की, तुझे इंग्रज सरकार पूर्णपणे संरक्षण करील, आणि पुराव्यावरून तुझा दावा खरा
आहे अशी खात्री होईल तर तुला वाजत्री न्याय मिळण्याच्या कामांत हयगय केली जाणार नाहीं. नामदार व्हाइसराय साहेब यांस ही शिफारस मान्य झाली नाहीं. ता० १५ नोवेंबर सन १८७३ च्या पत्रांत त्याणी मुंबई सरकारास असे कळविले की, वाईट राज्यव्यव स्येबद्दल आरोप आणिले आहेत त्याविषयी विशेष प्रमाणे दाखवून पुरावा करितां येईल, आणि नंतर आपल्या मध्यस्तीपासून जे चांगले परिणाम घडून येतील त्याचा फायदा कमिशनापुढे जे लोक फिर्यादी करितील त्यांस साहजिक मिळेल, परंतु हे तरी एकंदर राज्यकारभारावर जे दोष आणिले आहेत त्यांची शाविती होण्यावरच अवलंबून राहील. फक्त थोड्या तुटक मुकदम्यामध्ये अन्याय झाला म्हणून गायकवाड सरकारच्या राज्य- कारभारांत रिवाजाबाहेर मध्यस्ती करणे व्हाइसराय साहेब यांस उचित वाटत नाहीं.
- In entering on this branch of their duties, the Commission will be careful to
give no encouragement to frivolous or vexatious complaints, and their inquiry should be conducted not so much with a view to the redress of individual griveances, as for the purpose of ascertaining whether such general mal-adıninistration exists as to call for the further interference of the British Government." ( See Blue Book No. Il Page 31 Section 8.) + But if complainants of the former class are to be told that they mnst look for redress to the Durbar and that they will be, as it were, left to their mercy, we can not expect them to incur the risk of substantiating their cases before the Commission; and the inevitable result of its failure for want of evidence will be the perpetuation and aggravation of the existing evils. " His Excellency in Council, therefore, most earnestly recommends that the Com- mission should be empowered in the case of every complainant whose evidence they may decide on receiving to assure him that he will be fully protected by the British Government, and in the event of his complaint being established to their satisfaction the question of his receiving proper redress would not be passed over.
